These terms and conditions govern the use of the services provided by Cheerful Air Balloon Co. to the customer. By using our services, you agree to be bound by these Terms. Please read them carefully before engaging our services.

Section 1: Services Offered
1.1. Cheerful Air Balloon Co. offers balloon decoration services for various events, including but not limited to weddings, birthdays, private/corporate events, and parties.
1.2. The specific services, including design, materials, and setup, will be detailed in a proposal, invoice and/or through written correspondence with the Customer, outlining the scope of work and costs.
Section 2: Booking and Payments
2.1 To book our services, a 50% deposit is required. The deposit amount will be specified in the proposal and is due upon acceptance of the proposal.
2.2 Full payment of the remaining balance is due 14 days prior to your service, as specified in the invoice.
2.3 If payment is not received by due date, additional fees may apply to account for rush shipping of materials
2.4 We accept various payment methods, including credit card, check, cash, Venmo, or PayPal. Credit card and PayPal payments will incur a processing fee.
Section 3: Cancellation and Rescheduling
3.1. If the Customer wishes to cancel or reschedule services, they must notify Cheerful Air Balloon Co. as soon as possible. If the reason for canceling is beyond the control of the Company or the Customer, rescheduling would be strongly recommended. In the event of a full cancellation, payment can be applied to the account as a credit for a future service. Re-design and materials may have additional fees associated based on inventory at the time.
3.2. Cancellation or rescheduling will result in the forfeiture of the deposit, and additional fees may apply, depending on the timing of the cancellation or rescheduling.
3.3 If Cheerful Air Balloon Co. is unable to perform services due to illness, emergency, accident, or circumstances beyond its control, liability shall be limited to a refund of payments received, unless both parties agree to reschedule.
3.4 Cheerful Air Balloon Co. shall not be liable for failure to perform any obligations due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, government restrictions, or labor strikes.
Section 4: Design and Materials
4.1 Cheerful Air Balloon Co. will work with the Customer to create a balloon decor design based on the Customer's preferences and event requirements.
4.2 Cheerful Air Balloon Co. reserves the right to make minor adjustments to the design and materials used if necessary due to unforeseen circumstances, including but not limited to weather conditions and availability of specific materials.
4.3 All balloon designs, concepts, mockups, proposals, color palettes, installation plans, and pricing provided by Cheerful Air Balloon Co. are the intellectual property of Cheerful Air Balloon Co. and are created exclusively for the Client's consideration.
4.4 The Client agrees not to use, share, reproduce, distribute, or submit any design, proposal, quote, or pricing provided by Cheerful Air Balloon Co. for the purpose of obtaining competing bids, price matching, or having another vendor recreate or substantially replicate the proposed design without prior written consent. Design concepts remain the property of Cheerful Air Balloon Co. unless otherwise agreed to in writing.
4.5 Should the Client choose not to move forward with Cheerful Air Balloon Co., all proposals, mockups, and design materials remain confidential and may not be used by another individual or business to produce the event design.
Section 5: Setup, Installation, and Teardown
5.1 Cheerful Air Balloon Co. will arrange for the setup and installation of the balloon decor at the event location at the agreed-upon time.
5.2 The event location must be accessible and ready for setup at the specified time. Delays or additional setup requirements may result in additional charges.
5.3 The Client is responsible for securing all necessary permissions from the event venue regarding the installation, placement, and removal of balloon decor and rental equipment. The Client warrants that the venue has approved the proposed installation and that all venue rules, restrictions, and requirements have been communicated to Cheerful Air Balloon Co. prior to the event.
The Client shall ensure that the installation area is clean, safe, accessible, and available at the scheduled installation time. Adequate parking, loading access, elevators (if applicable), and a clear path for transporting equipment must be provided.
Cheerful Air Balloon Co. is not responsible for damages resulting from venue restrictions, unsuitable installation surfaces, or venue personnel moving, modifying, or removing any portion of the decor after installation. If venue staff require modifications to the installation after setup has begun or has been completed, any resulting labor, redesign, or damages shall be the responsibility of the Client.
5.4 Once installation has been completed and accepted by the Client or venue representative, Cheerful Air Balloon Co. shall not be responsible for any damage, movement, collapse, theft, vandalism, popping, deflation, oxidation, or deterioration of the décor caused by environmental conditions, venue conditions, or third parties.
5.5 Cheerful Air Balloon Co. shall not be liable for delays caused by traffic, accidents, road closures, venue restrictions, weather, or other circumstances beyond its reasonable control.
5.6 Teardown service needs to be discussed prior to payment and will include additional charges to account for time and mileage. Unless teardown services have been purchased, disposal of balloons and decor after the event is the Client's responsibility.
Section 6: Rental Equipment
6.1 All rental equipment, including but not limited to backdrop stands, balloon frames, pedestals, signage, props, easels, cylinders, and other event items, remain the property of Cheerful Air Balloon Co.
6.2 The Client assumes responsibility for all rental items from the time of installation until retrieval. The Client is responsible for any loss, theft, misuse, or damage beyond normal wear and tear. Replacement or repair costs will be charged to the Client at the current replacement value.
Section 7 : Liability
7.1 While Cheerful Air Balloon Co. takes all reasonable precautions during setup, we are not liable for any personal injury, property damage, or other loss occurring during or after our services, except in cases of gross negligence.
7.2 The Customer is responsible for ensuring that the event location is safe and suitable for the balloon decor installation.
Section 8: Weather and Environmental Factors
8.1 The Client acknowledges that balloons are highly sensitive to environmental conditions. To maximize the quality and lifespan of the décor, balloons should be kept away from direct sunlight, excessive heat, freezing temperatures, high humidity, sharp objects, and strong winds whenever possible.
8.2 Cheerful Air Balloon Co. is not responsible for balloon popping, oxidation (fading or dulling of balloon color), deflation, discoloration, or any other damage resulting from exposure to sunlight, heat, cold, adverse weather conditions, or other environmental factors beyond our control after installation or delivery. The Client assumes responsibility for maintaining appropriate conditions for the balloon décor once it has been delivered or installed.
8.3 Outdoor balloon installations are performed at the Client's request and entirely at the Client's risk. Weather conditions including wind, sun, rain, humidity, temperature fluctuations, and other environmental factors may significantly reduce the lifespan or appearance of the décor. No warranty is provided for outdoor installations.
8.4 While we use our best judgement, Cheerful Air Balloon Co. cannot be held responsible for any damage or alteration of the decor after installation due to such conditions.
Section 9: Photo and Marketing Release
9.1 Cheerful Air Balloon Co. reserves the right to photograph completed decor for portfolio and promotional purposes.
9.2 If the Customer prefers not to have photos shared, they must notify us in writing before the event date.
Section 10: Termination of Services
10.1 Cheerful Air Balloon Co. reserves the right to terminate services if the Customer fails to comply with these Terms or if the event location becomes unsafe or unsuitable for installation.
Section 11: Amendments to Terms
11.1 Cheerful Air Balloon Co. may update these Terms from time to time. Customers will be notified of any changes, and the updated Terms will be posted on our website.
Section 12: Governing Law and Dispute Resolution
12.1 These Terms are governed by the laws of the state of Missouri. Any disputes arising from or relating to these Terms shall be resolved through negotiation, arbitration, or mediation, as specified in the proposal or agreement. By engaging our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
